Terms of Service

The terms for using HiringDesk recruiting, applicant messaging, scheduling and job board services.

1. Service description

HiringDesk provides recruiting software for employers, recruiters and job seekers. Features may include application intake, candidate organization and scoring, text and email communication, video introductions, interview scheduling, careers pages, an embeddable widget, a job board, reporting and related support. These Terms govern access to and use of HiringDesk.

2. Eligibility and accounts

You must be at least 18 and able to enter a binding agreement to create an employer account. You must provide accurate account information, keep login details secure and promptly tell us about suspected unauthorized use. You are responsible for activity under your account and for making sure each team member has appropriate access.

3. Customer responsibilities

Customers are responsible for their hiring process and for using HiringDesk lawfully. You agree to:

  • Use fair, lawful and non-discriminatory hiring practices and follow equal employment opportunity requirements.
  • Publish accurate job descriptions, qualifications, locations, compensation statements and employer information.
  • Obtain and document an applicant's consent before sending recruiting texts or emails, and honor STOP and other opt-out requests.
  • Follow the Telephone Consumer Protection Act, carrier and 10DLC rules, state messaging laws, employment laws and applicable AI-in-hiring notice, audit and consent requirements.
  • Review automated recommendations and make final hiring decisions through a qualified person.
  • Give team access only to people authorized to handle applicant information and keep that information confidential.

HiringDesk provides tools and product safeguards, not legal advice. You are responsible for deciding which laws apply to your business and hiring activities.

4. Acceptable use and prohibited content

You may not use HiringDesk to break the law; mislead or harass people; send messages without consent; evade opt-outs; scrape or resell data; interfere with the service; probe security; upload malware; impersonate another person or employer; or access another workspace without permission.

Job listings and messages may not promote scams, deceptive offers, multi-level marketing or pyramid schemes, adult or sexual services, illegal products or services, discriminatory requirements, or content that threatens, exploits or harms others. We may investigate suspected misuse and remove content or access when reasonably necessary.

5. Job board and free postings

HiringDesk may offer hosted careers pages, job board distribution and free job postings. A submitted posting is not guaranteed to appear or remain available. We may review, reject, correct formatting, edit for clarity, limit distribution or remove any posting. Free postings require approval and may be prioritized below paid or sponsored listings. Employers remain responsible for the accuracy, legality and hiring decisions connected with their postings.

6. AI and automated tools

Automated tools and AI may help parse résumés, summarize answers, score job-related information, draft messages, suggest next steps and schedule interviews. They are assistive tools, not a substitute for human judgment. A person must make the final hiring decision. HiringDesk does not guarantee a hiring outcome, candidate quality, attendance, retention, legal compliance or the accuracy of every automated output. Customers must review outputs before relying on them.

7. Billing, plans and cancellations

Paid plans are billed monthly or yearly and include the active roles, seats and monthly applicants worked allowance shown at purchase. Yearly plans are priced at the equivalent of ten monthly payments. Extra roles, extra seats, Boost services and applicant top-up packs may cost extra. An applicant is worked when HiringDesk begins outbound work for that applicant; replies, follow-ups, video, booking and reminders are included as described in the plan.

Subscriptions renew automatically until canceled. You authorize us and our payment processor to charge the payment method on file for recurring fees, approved add-ons, top-ups, overages and applicable taxes. Automatic top-up, when enabled, buys the configured pack when the available allowance runs low, subject to the account's monthly cap.

You may cancel before the next renewal from Billing. Cancellation stops future renewal and access continues through the paid period unless the service is suspended for cause. Fees are non-refundable and we do not provide refunds or credits for partial billing periods, unused time, unused plan allowances or a mid-period cancellation, except where required by law or expressly stated for a particular service. A pause plan, when available, keeps specified account data and features available at the displayed monthly price while outreach is paused.

8. Data ownership and license

Customers and individuals keep ownership of the information and content they provide. You give HiringDesk a limited, non-exclusive license to host, copy, process, transmit and display that content only as needed to provide, secure and improve the service, meet your instructions and comply with law. You represent that you have the rights and permissions needed to provide the content.

HiringDesk owns the service, software, design, documentation, aggregate statistics and de-identified insights. We do not claim ownership of employer job content, candidate applications or job seeker profiles.

9. Confidentiality

Each party may receive non-public business, technical or personal information from the other. Each party will use reasonable care to protect it and will use it only to perform under these Terms. This does not cover information that was already lawfully known, becomes public without a breach, is independently developed or is lawfully received from another source. A party may disclose information when legally required after giving notice when permitted.

10. Third-party services

HiringDesk works with third-party services such as Google for connected calendars, Telnyx for text and voice delivery, Stripe for payments, Resend for email delivery, and similar hosting, database, analytics and AI providers. Their own terms and privacy policies may apply to services you connect or receive through them. HiringDesk is not responsible for a third party's independent service, outage or policy change, but we will use reasonable efforts to keep core HiringDesk workflows available or provide a fallback where practical.

11. Disclaimers

HiringDesk is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not promise that the service will always be uninterrupted, error-free or secure, or that any applicant will respond, attend an interview or be suitable for a job. HiringDesk does not provide legal, tax, employment or compliance advice.

12. Limitation of liability

To the fullest extent allowed by law, HiringDesk and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill, data or business opportunity, even if advised that they were possible.

To the fullest extent allowed by law, HiringDesk's total liability for all claims arising from the service or these Terms will not exceed the amount the customer paid HiringDesk during the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

13. Indemnification

You will defend, indemnify and hold HiringDesk and its affiliates harmless from third-party claims, damages, losses and reasonable costs arising from your job postings, hiring decisions, messages, content, violation of law, violation of these Terms or infringement of another person's rights. HiringDesk will promptly notify you of a covered claim and allow you to control the defense, while retaining the right to participate with its own counsel.

14. Suspension and termination

You may stop using HiringDesk and cancel your plan at any time. We may suspend or terminate access when payment is overdue, use creates a security or legal risk, a customer sends unlawful or non-consensual messages, content violates these Terms, or a customer materially breaches these Terms. When practical, we will give notice and an opportunity to fix the issue. We may act immediately to protect applicants, customers, the service or the public.

After termination, rights that by their nature should continue will survive, including payment obligations, ownership, confidentiality, disclaimers, liability limits, indemnification and governing law. Data is handled as described in the Privacy Policy.

15. Changes to these Terms

We may update these Terms when the service, pricing or law changes. We will post the updated version and change the Last updated date. For a material change, we will provide reasonable notice when appropriate. Continuing to use the service after the effective date means you accept the updated Terms. If you do not agree, you must stop using the service and cancel before the change takes effect.

16. Governing law

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Michigan, and each party consents to their jurisdiction and venue.
